María José Luque studierte von 2003 bis 2008 Rechtswissenschaften an der Universidad Católica Santiago de Guayaquil, Ecuador. 2011 schloss sie ein Magister Legum Studium mit magna cum laude an der Juristischen Fakultät der Universität Potsdam im Rahmen ihres DAAD-Stipendiums für Doktoranden ab. Sie fertigte eine Magisterarbeit zum Thema „Beitritt der EU zur EMRK und die Auswirkungen auf den Individualrechtsschutz“ an.

 

Von 2012 bis 2018 arbeitete sie an ihrer Dissertation zum Thema „International Investment Protection and the Duty of Latin American States to Regulate Private Foreign Investment in Furtherance of Human Rights“, die von Prof. Dr. Markus Krajewski betreut wurde. In diesem Zeitraum wurde ihre Promotion zudem durch ein Stipendium der FAU Erlangen-Nürnberg aus Mitteln des STIBET-Doktorandenprogramms des DAAD finanziert. Im Mai 2019 schloss sie ihr Promotionsverfahren mit magna cum laude ab. Im November 2019 wurde die Veröffentlichung ihrer Dissertation in EYIEL Monographs – Studies in European and International Economic Law zugelassen.

 

Von März 2019 bis März 2020 wirkte María José Luque (fernbedient) im Oxford International Organization (OXIO) Project – International Economic Law Section mit, wo sie „Headnotes“ über den rechtlichen und institutionellen Rahmen zweier Wirtschaftsorganisationen in Lateinamerika ausarbeitete.

 

Seit April 2020 arbeitet María José Luque am Forschungsprojekt „The Recognition of a „Human“ Right to Healthy Environment and its Implications for Accessing the Inter-American Human Rights System“ in diesem Lehrstuhl, mittels eines Überbrückungsstipendiums für exzellente wissenschaftliche Nachwuchskräfte der FAU Erlangen-Nürnberg, aus den Mitteln der Ilse-und-Dr.-Alexander-Mayer Stiftung. Mit diesem Thema untersucht sie die Auswirkungen dieser rechtlichen Entwicklung auf den Zugang der Betroffenen durch die Unterlassung von OAS Mitgliedstaaten, den Klimawandel zu bekämpfen, und auf den Zugang der betroffenen durch die Unterlassung der Vertragsstaaten der AMRK, Umweltschäden im Allgemeinen zu verhindern.

María José Luque studied Law between 2003 and 2008 at the Law Faculty of the Universidad Católica Santiago de Guayaquil, Ecuador. In 2011 she completed a Master of Laws degree (LL.M.) with magna cum laude, at the Law Faculty, University of Potsdam, within the framework of her DAAD scholarship for doctoral candidates. She wrote a thesis in German on the EU accession to the ECHR and the impact on the protection of individual rights.

 

From 2012 until 2018 she worked on her doctoral study “International Investment Protection and the Duty of Latin American States to Regulate Private Foreign Investment in Furtherance of Human Rights”, under the supervision of Prof. Markus Krajewski. This study was funded in addition with a scholarship provided by the FAU Erlangen-Nurnberg, from funds of the STIBET-DAAD doctoral program. In May 2019 she concluded her doctoral procedure with magna cum laude. In November 2019 her doctoral study was admitted for publication in EYIEL Monographs – Studies in European and International Economic Law.

 

Between March 2019 and March 2020 she remotely collaborated with the Oxford International Organization (OXIO) Project – International Economic Law Section, by developing two headnotes about Latin American regional organizations.

 

Since April 2020 she works on the research project ‚The Recognition of a “Human” Right to Healthy Environment and Its Implications for Accessing the Inter-American Human Rights System‘ at this Chair, funded through a bridging scholarship for excellent young scientists of the FAU Erlangen-Nürnberg, from funds of the Ilse-and-Dr.-Alexander-Mayer Foundation. With this topic, she analyses the implications of this legal development for the access of those affected by OAS member states’ inaction to tackle climate change, and for the access of those affected by the inaction of states parties to the ACHR to prevent environmental harms.
